These Terms and Conditions ("Terms") constitute a legally binding agreement between Fairdeal.ng ("Fairdeal", "we", "us", or "our") and any individual, business, organization, or entity ("User", "you", or "your") that accesses, registers on, or uses the Fairdeal.ng platform.
By accessing or using Fairdeal.ng, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the platform.
1. About Fairdeal.ng
Fairdeal.ng is an online classified advertising marketplace that enables users to advertise, market, buy, sell, rent, and promote products and services within Nigeria. The platform serves as a technology-based marketplace that facilitates connections and communications between users.
Unless expressly stated otherwise, Fairdeal.ng is not a party to transactions conducted between users and does not own, manufacture, store, inspect, broker, guarantee, or control the products or services advertised on the platform. The responsibility for all listings, negotiations, transactions, deliveries, payments, warranties, and related matters rests solely with the users involved.
2. Eligibility
Use of Fairdeal.ng is limited to persons who have the legal capacity to enter into binding agreements under applicable laws.
By using the platform, you represent and warrant that:
• You are at least eighteen (18) years of age or are using the platform under the supervision of a parent or legal guardian who accepts responsibility for your use of the platform.
• You possess the legal authority to enter into and comply with these Terms.
• All information you provide to Fairdeal.ng is accurate, complete, current, and truthful.
• Fairdeal.ng reserves the right to deny access to, suspend, or terminate any account that does not satisfy these eligibility requirements.
3. User Registration and Accounts
Certain features of Fairdeal.ng require account registration. Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their accounts.
You agree to provide accurate and complete information during registration and to promptly update any information that becomes inaccurate or outdated.
You are solely responsible for safeguarding your account and password. Fairdeal.ng shall not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to maintain appropriate security measures.
We reserve the right to suspend, restrict, or permanently terminate accounts that violate these Terms or engage in conduct that may compromise the security, integrity, reputation, or lawful operation of the platform.
4. Know Your Customer (KYC) Verification
To maintain a secure marketplace, prevent fraud, comply with applicable laws, and enhance user trust, Fairdeal.ng requires sellers and certain categories of users to complete identity verification procedures before they may publish advertisements or offer products and services on the platform.
As part of this process, Fairdeal.ng may require users to submit information and documentation including, but not limited to, their full legal name, date of birth, residential address, telephone number, email address, National Identification Number (NIN), government-issued identification documents, proof of address, business registration documents, tax information, photographs, biometric verification data, or any other information reasonably required for verification purposes.
Users warrant that all information and documents submitted for verification are authentic, accurate, complete, and belong to them. The submission of false, misleading, forged, altered, stolen, or fraudulent documents shall constitute a material breach of these Terms and may result in immediate account suspension, permanent account termination, removal of listings, cancellation of transactions, forfeiture of promotional services, and referral to law enforcement or regulatory authorities where appropriate.
Fairdeal.ng reserves the right to conduct verification checks through third-party verification providers, government databases, identity verification services, credit agencies, fraud prevention systems, or other lawful sources.
Completion of KYC verification does not constitute an endorsement, certification, recommendation, guarantee, or warranty regarding a user's credibility, trustworthiness, financial status, reputation, or ability to perform contractual obligations.
Fairdeal.ng reserves the right to refuse, suspend, revoke, or require renewed verification at any time where information becomes inaccurate, outdated, suspicious, incomplete, or inconsistent with legal or regulatory requirements.
No user shall be permitted to publish listings, advertise products or services, or operate as a seller on Fairdeal.ng until all required verification procedures have been successfully completed and approved by Fairdeal.ng.
5. User Content and Advertisements
Users are solely responsible for all content submitted to Fairdeal.ng, including advertisements, photographs, descriptions, logos, videos, reviews, comments, messages, and other materials.
By submitting content to the platform, you represent and warrant that:
You own or possess all rights necessary to publish such content.
The content is truthful, accurate, lawful, and not misleading.
The content does not infringe any intellectual property rights, privacy rights, contractual rights, or other legal rights of any third party.
By posting content on Fairdeal.ng, you grant Fairdeal.ng a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify, distribute, publish, display, and promote such content for purposes related to the operation, development, security, and promotion of the platform.
Fairdeal.ng reserves the right, but not the obligation, to review, edit, reject, suspend, or remove any content that violates these Terms or applicable laws.
6. Prohibited Activities and Listings
Users shall not use Fairdeal.ng for unlawful, fraudulent, deceptive, abusive, harmful, or unauthorized purposes.
Without limitation, users may not advertise, sell, purchase, distribute, promote, or facilitate transactions involving illegal products, stolen property, counterfeit goods, prohibited drugs, weapons, explosives, adult content, fraudulent financial schemes, fake employment opportunities, forged documents, illegal services, or any other item prohibited by Nigerian law.
Users are also prohibited from engaging in conduct that may disrupt the operation of the platform, compromise security, interfere with other users, harvest personal information without consent, distribute malicious software, manipulate listings, impersonate another person or organization, or otherwise misuse the platform.
Fairdeal.ng reserves the right to remove content and take enforcement action against users engaged in prohibited activities.
7. Transactions Between Users
Fairdeal.ng serves solely as a marketplace platform and is not a party to transactions conducted between users.
Users acknowledge that Fairdeal.ng does not verify the quality, safety, legality, authenticity, ownership, availability, or suitability of products or services listed on the platform. Fairdeal.ng also does not guarantee that buyers will make payment or that sellers will deliver products or services as promised.
All transactions are conducted entirely at the users' own risk. Users are responsible for exercising reasonable caution, conducting due diligence, inspecting goods where appropriate, verifying identities, and taking necessary precautions before completing any transaction.
Fairdeal.ng shall not be liable for any loss, damage, injury, fraud, dispute, claim, or expense arising from interactions or transactions between users.
8. Fees and Premium Services
Fairdeal.ng may offer paid services including featured listings, advertisement boosts, subscription plans, promotional placements, business profiles, and other premium services.
By purchasing any paid service, you agree to pay all applicable fees and charges associated with such services.
Unless otherwise required by law or stated in a separate refund policy, fees paid for advertisements, promotions, subscriptions, and related services are non-refundable once the service has commenced or been delivered.
Fairdeal.ng reserves the right to modify pricing, introduce new charges, or discontinue services at any time.
9. Intellectual Property Rights
All rights, title, and interest in and to Fairdeal.ng, including its software, source code, databases, trademarks, logos, graphics, content, designs, features, and technology, remain the exclusive property of Fairdeal.ng and its licensors.
Nothing contained in these Terms grants users any ownership rights in the platform or its intellectual property.
Users shall not copy, reproduce, modify, distribute, reverse engineer, scrape, extract, or otherwise exploit any portion of the platform without prior written consent from Fairdeal.ng.
10. Privacy and Data Protection
Fairdeal.ng collects, stores, processes, and uses personal information in accordance with its Privacy Policy and applicable data protection laws, including the Nigeria Data Protection Act and related regulations.
By using the platform and participating in KYC verification procedures, users consent to the collection, storage, verification, processing, and lawful disclosure of their information as necessary for platform operations, fraud prevention, regulatory compliance, security monitoring, dispute resolution, and law enforcement cooperation.
11. Disclaimer of Warranties
Fairdeal.ng is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted by law, Fairdeal.ng disclaims all warranties relating to availability, reliability, performance, merchantability, fitness for a particular purpose, non-infringement, accuracy, security, and uninterrupted operation.
We do not guarantee the accuracy of listings, the conduct of users, the outcome of transactions, or the continuous availability of the platform.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Fairdeal.ng, its directors, officers, employees, affiliates, agents, licensors, contractors, and partners shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising from or relating to the use of the platform.
This limitation applies to loss of profits, loss of business opportunities, loss of revenue, loss of goodwill, loss of data, service interruptions, fraud, unauthorized access, failed transactions, personal injury, property damage, or any other losses.
In all circumstances, Fairdeal.ng's total aggregate liability shall not exceed the amount paid by the user to Fairdeal.ng during the six (6) months immediately preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Fairdeal.ng, its directors, officers, employees, affiliates, agents, contractors, and partners from and against any claims, liabilities, losses, damages, costs, expenses, penalties, or legal fees arising from your use of the platform, your advertisements, your transactions, your violation of these Terms, or your infringement of any rights belonging to third parties.
14. Suspension and Termination
Fairdeal.ng reserves the right, at its sole discretion and without prior notice, to suspend, restrict, remove content from, or permanently terminate any account where it reasonably believes that a user has violated these Terms, engaged in unlawful conduct, submitted fraudulent KYC information, compromised platform security, or otherwise acted contrary to the interests of the platform or its users.
15. Amendments
Fairdeal.ng reserves the right to amend, modify, replace, or update these Terms at any time. Revised Terms shall become effective immediately upon publication on the platform unless otherwise stated.
Continued use of Fairdeal.ng after publication of revised Terms constitutes acceptance of the updated Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Any dispute arising out of or relating to these Terms, the platform, or the relationship between Fairdeal.ng and its users shall first be addressed through good-faith negotiations. Where a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Nigeria, which shall have exclusive jurisdiction over such matters.
